COMMONWEALTH
ALUMINUM CORPORATION CONTINUOUS RAINWARE ALUMINUM COIL FOR
USE AS RAIN CARRYING EQUIPMENT LIMITED TWENTY (20) YEAR
WARRANTY
The
manufacture, Commonwealth Aluminum Corporation warrants
that the finish on your Commonwealth Aluminum continuous
aluminum gutter will not blister, peel, crack, chip,
flake, check, or split for a twenty (20) year period from
the date of installation if, on proper invocation by the
manufacture, or its appointed depreciative, it is
disclosed that the finish has blistered, peeled, cracked,
chipped, flaked, checked or split within said twenty (20)
year period, the manufacture will be responsible for cost
of refinishing or repairing defective material or where
applicable, a refund on the following pro-raced basis,
100% during the first year, 100% of the cost of cleaning
refinishing, or replacing for the first year of the
warranty period.
For each succeeding year of the warranty, CAC’s
obligation shall be reduced by 5% of the cost such that by
the twentieth (20th) year CAC shall assume only 5% of the
total cost to clean, refinish, or replace a defective
Product.
Refinishing
or replacement of defective material is at the option of
the manufacture. The
bias for determining cost recoverable under this warranty
is as follows: refinishing the current prevailing area
finishing cost replacement of the-the price of
Commonwealth continuous aluminum coil at the time of
settlement or the original price of the material, all at
the sole discretion of Commonwealth Aluminum Corporation.
This warranty covers the material only.
The manufacture is no way responsible for forming,
stamping, or installation, which is the responsibility of
the distributor, dealer contractor, or applicator.
This
warranty does not cover damage or deterioration caused by
faulty installation, collation with foreign objects, hail,
ice, lighting, earthquakes, erosion, explosions, external
forces, normal weathering, riots, vandalism, civil
commotion’s misuse, or other occurrtences beyond the
control of the manufacture.
This
warranty applies only to the finish applied on continuous
coil material and accessories manufactured and sold by
Commonwealth Aluminum Corporation.
Finishes applied by anyone other than Commonwealth
Aluminum Corporation are excluded from this warranty.
ANY IMPLIED
WARRANTIES OF MERCHANTABILITY OR ANY IMPLIED WARRANTY OF
FITNESS FOR A PARTICULAR USE ARE LIMITED IN DONATION TO
TEN (10) YEARS, SELLERS MAKE NO WARRANTY, EXPRESS OR
IMPLIED OTHER THAN SET FORTH HERE, OR REQUIRED BY LAW.
Liability
of the manufacture is limited to the purchase price.
SELLER SHALL IN NO LIABLE FOR INCIDENT OR CONSEQUENTIAL
DAMAGES ANY KIND WHATSOEVER WHETHER ALLEGED TO HAVE RESULTED
FROM DELAY IN DELIVER, DELIVERY OF NON-CONFORMING MATERIAL,
DEFICIENCIES IN MATERIAL, OR ANY OTHER CAUSE WHATSOEVER,
AND WHETHER ARISING FROM BREACH OF CONTRACT, BREACH OF
WARRANTY, TORY, INCLUDING, NEGLIGENCE, STRICT LIABILITY OR
OTHERWISE. The
ready set for above shall be exclusive.
Some
states do not allow limitations on how long an implied
warranty lasts. Or the exclusive or limitation of consequential damages, so
the above limitations or exclusions may not appeal to you.
This
warranty gives you specific legal rights and may also have
other rights which vary, from state to state.
All claims under this warranty
must be made in writing within thirty (30) days after
appearance or any defect.
This warranty is not effective unless signed and
dated by the installing dealer at time of installation.
This warranty extends to the original purchaser
only and cannot be assigned or otherwise transferred.

of Overexposure : High Exposures may produce
irritation of the eyes and respiratory tract.
It exposures for aluminum oxide are kept below
the TLV’s the alloy components should not present
any helth risk. Welding
or cutting aluminum may generate ozone.
Overexposure to ozone can cause mucous membrane
irritation and pulmonary changes including irritation,
congestion and edems.
